Why do businesses and families underutilize their business and estate planning attorneys?
Business attorneys have the ability to tell the legal future of a business in many ways. Estate planning attorneys have the ability to tell the legal future of a family in many ways. This is because we spend a great deal of our time either reading about the future, writing about the future, or helping a company or family navigate a successful or painful present.
Companies and families generally have many similarities, therefore legal success and pain are also experienced similarly. Success or pain generally comes down to decision making ability and judgment. For whatever reason, some are better than others at decision making and judgment. In order to maximize your ability to think clearly, hire a business attorney or estate planning attorney to help guide your future decision making from a legal standpoint.
Rather than simply hiring these attorneys to work on a contract or an estate plan, hire them to prepare a legal memorandum for you outlining actions they recommend that you take to address your greatest legal fears and to also address matters you have never considered.
I can help cure your past, respond to your present legal mess, but most importantly I can help set you on a smooth trajectory to ensure
that you avoid making terrible legal past and present decisions.
What is this worth? I’ll tell you what it was worth to one of my prospective clients. It was worth less than $150,000.00 in legal fees and fees he had to pay out to his partner after experiencing a preventable legal loss. He could have avoided this legal pain simply by having an attorney prepare a memorandum for him to outline this predictable legal nightmare.
It is unlikely that I will change the nature of people as I work to build the strongest law firm in the world, and my firm will continue to focus on business law, estate planning, and civil litigation in a traditional sense for now.
However, part of my strategy in building the strongest law firm in the nation is to help educate the public, so that they know how to fully utilize my abilities as attorney.
To add additional context, I went up against another law firm regarding a business law matter. This law firm represented a client’s business in matters involving litigation. I was able to defeat this firm and their client simply by finding their client’s preventable legal weakness. This was a weakness this client’s law firm could have easily remedied, but for whatever reason it was not remedied. I am nearly certain about one thing. This client probably never paid this law firm to draft a memorandum outlining legal actions he should take to avoid such a defeat.
