Discretionary immigration cases deal with case-by-case situations. They are commonly used to determine an immigrant’s eligibility for benefits or citizenship based on exceptional merits.
Whether or not the immigrant is granted, a benefit is at the discretion of the court in these cases rather than specifically outlined precedents and litigation laws.
Family-based immigration cases are cases where legal citizens or immigrants can petition for specific family members to be given visas.
These types of cases are often used to get parents, children, and other dependents into the country faster than going through the standard immigration process.
At first glance, these both seem like similar types of cases, but they vary dramatically when it comes to the subject matter.
A discretionary case typically deals with providing potential immigrants with benefits or visas, but a family-based case works to provide immediate family members of existing immigrants with visas to prevent long-term separation.

Removal immigration cases are serious matters that are used to determine whether an immigrant may stay in the country or be forced to leave. These are typically brought up when an immigrant no longer meets visa requirements, commits a crime, or didn’t come into the country legally in the first place.
The proceedings for removal cases are held in a courtroom. When your immigration status is challenged, you will need to appear before a judge and plead your case. Failing to prove your innocence in a crime, meeting your visa requirements, or that you’re in the country legally can all lead to being deported.
If an immigrant, legal or illegal, is the victim of a crime, there are protections in place. Immigrants are not deported for reporting crimes, and they can take the same legal actions as citizens. For example, reporting crimes regarding violence, sexual crimes, employment crimes, etc are all protected.
If an immigrant fled their home country due to dangerous conditions such as war, and it is dangerous for them to return, affirmative asylum is an option to allow them to stay in the United States until it is safe for them to return. An immigration attorney can help with this matter, along with filing the appropriate forms.
There are two main types of citizenship-related cases. The first is cases that call into question federal laws regarding citizenship, and these are often used to determine whether someone may stay in the country during various situations, gain certain benefits, etc.
Then, there are diversity of citizenship cases that handle disputes between two people who are citizens of different countries, such as a US citizen and a Honduran citizen disputing an employment issue.
Other cases that might involve removal involve education visa requirements not being met, work visa requirements not being met, housing requirements, etc.

Immigrant and non-immigrant visas both allow non-US citizens to stay in the country, but they’re for two different types of immigrants.
Immigrant visas are for those who aim to stay in the country permanently but have not yet attained citizenship.
A non-immigrant visa is for those who live elsewhere but would like to temporarily stay in the US due to work, tourism, family visitation, education, etc.
An employment-based visa is specifically meant to help skilled workers from other nations work with American companies.
These can be issued on a temporary, seasonal, or permanent basis, depending on the job being done. They are most commonly issued to permanent workers who plan to work in the US indefinitely. To apply, you must get an application from the US Department of State.
- L1-Petition: This is a visa for long-term employees of international companies who need to work in the US due to a transfer. This usually consists of specialized workers, execs, and top-level employees.
- EB-1A: These are visas given to exceptional talents from around the world who demonstrate excessive value in their field.
- O1 Visa: These are visas given to exceptional athletes, science arts, education, and business employees.
- E2 Petition: This is a visa granted to non-immigrant workers from countries the US has a treaty with.
- Expert Letters for O1 and Endorsement Letters for EB-1A and Up to 6: These are the endorsement letters needed to prove you are an exceptional member of your field with original contributions.
- National Waiver Interest: This is a waiver that allows some E-2 visa holders to bypass the work requirements of an E-2 visa.
H-1B: H-1B visas are non-immigrant visas for workers who hold bachelor’s degrees or higher in a specialized field.
